VANCITY TERMS OF USE FOR DIGITAL WALLETS
- Introduction
These terms of use (Terms of Use) apply when you, the cardholder, (You) choose to add a Vancity Visa credit card or Vancity debit card to a Digital Wallet. Your use of the Digital Wallet will also be subject to the terms and conditions that you agreed to with the Digital Wallet.
- Definitions
Here are the definitions for some words that we use in these Terms of Use. When we use these words in these Terms of Use, they are capitalized.
“Card” means your Vancity Visa Credit Card or Vancity MEMBER CARD® debit card or such other card provided to You by Vancity that allows access to Vancity services and that is eligible for use in connection with a Digital Wallet.
“Card Account” means the account associated with your Card;
“Card Contract” means the contract(s) in place between You and Vancity applicable to your Card and the related Card Account;
“Credentials” means personal access codes, user IDs, PINs, passwords, fingerprints or other information or credentials required for You to enter into transactions with your Card using the Wallet;
“Device” means a mobile phone, tablet, watch or other device that supports a Wallet;
“Digital Wallet” means an application or electronic service that stores information associated with your Card(s) and that allows You to make purchases using the Card Account that is associated with a Card;
“Digital Wallet Provider” means the provider of the applicable Digital Wallet;
“Eligible Card” means a Card that we indicate is eligible to be added to a Digital Wallet; and
“We”, “Us” or “Vancity” means Vancouver City Savings Credit Union, the issuer of your Card.
- Agreement
When You add an Eligible Card into a Digital Wallet, it will mean that You agree to all of these Terms of Use. These Terms of Use will also apply to anyone else You authorize to add an Eligible Card into a Digital Wallet.
- Your Card Contract Does Not Change
The Card Contract that governs your Card does not change when You add your Card to the Digital Wallet. Your Digital Wallet simply provides You with another way to enter into transactions using your Card. What that means is that any applicable interest, fees and charges that apply to your Card and all other matters set out in the Card Contract will also apply when You use a Card in your Digital Wallet.
- Fees and Charges
We do not charge any additional fees for adding or using your Card in a Digital Wallet. However, the Digital Wallet Provider and other third parties such as wireless companies or data service providers may charge You fees in connection with the use of your Digital Wallet, such as wireless data or roaming fees.
- Adding a Card to the Digital Wallet
To add a Card into a Digital Wallet, your Card Account must be in good standing. In addition, You will not be permitted to add a Card to a Digital Wallet if:
- your Card or Card Account has been closed, cancelled or suspended;
- You have failed to fulfill any of your responsibilities under the Card Contract; or
- we are unable to authenticate the Card in accordance with our procedures.
- Using a Card in the Digital Wallet
When your Eligible Card is added to a Digital Wallet, You will be able to use your Card to engage in transactions wherever the Digital Wallet is accepted. The Digital Wallet may not be accepted at all places where your Card is accepted.
- Maximum Transaction Amounts
Vancity, the Digital Wallet Provider, or the merchant may implement maximum dollar limits for purchases made using a Digital Wallet. If You wish to enter into transactions that exceed a maximum dollar amount, You should use your physical Card or another payment method.
- Blocking or Removing a Card from the Digital Wallet
You can remove a Card from the Digital Wallet at any time by following the Digital Wallet Provider's procedures for removal. We can block You from adding an otherwise Eligible Card into the Digital Wallet or suspend or terminate your ability to use an Eligible Card to make transactions using the Digital Wallet, at any time for any reason, subject to applicable law. Such reasons may include:
- if we suspect fraud on your Card;
- if we suspect your Device may have been lost, stolen or compromised;
- if You violate these Terms of Use or your Card Contract;
- laws that apply to the Digital Wallet or transactions using the Digital Wallet change; or
- your Card Account is not in good standing. Vancity always reserves the right to discontinue offering or supporting any Card enrolled in the Digital Wallet.
- Vancity is not Responsible for the Digital Wallet
The Digital Wallet is provided to You by the Digital Wallet Provider and not by Vancity. Vancity is only responsible for the Card and for supplying secured information to the Digital Wallet Provider to allow the Card to be used in the Digital Wallet. This means Vancity is not responsible for the performance or non-performance of the Digital Wallet or for You being unable to pay with a Card in your Digital Wallet for any transaction. Vancity is not responsible for any inconvenience or loss You may suffer if a merchant is not willing or is unable to accept a Card loaded into a Digital Wallet. The Digital Wallet may be terminated by the Digital Wallet Provider at any time.
- Security/Taking Care of your Credentials
You must be careful and maintain the confidentiality of your Credentials. You alone are responsible for keeping your Credentials confidential. If You share these Credentials with any other person, they may be able to access your Digital Wallet and enter into transactions using your Card or be able to obtain access to your personal information. If fingerprint or other biometric Credentials have been enabled on a Device, they may be used for accessing the Digital Wallet. If any fingerprints(s) or other biometric Credentials other than your own are registered on your Device, You should not utilize the Digital Wallet. If you discard, give away, or sell your Device, You must disable the Digital Wallet on the Device or otherwise disassociate your Card Account(s) from the Device. You must tell us immediately if your Credentials have been compromised or stolen or if You think that they may have been or if someone may have used your Credentials without authorization. Call us 24 hours a day, 7 days a week at 604.877.4999 or at 1.800.611.8472 or collect at 604.708.7810 if you are outside Canada or the U.S. In addition, because your Device can be used like a Card to make purchases, You must tell us immediately that your Device is lost or stolen in the same manner as if your actual Card was lost or stolen. We will resolve any potential errors or fraudulent transactions in accordance with the Card Contract.
- Your Personal Information
When You choose to add an Eligible Card to your Digital Wallet, we collect certain information from both You and the Digital Wallet Provider to verify your identity, to authenticate your Card, and to enable You to participate in the Digital Wallet and to allow You to enter into transactions with the Digital Wallet that are charged to your Card Account. We also collect from the Digital Wallet Provider (and exchange with the Digital Wallet Provider), Visa and other service providers, information about You to facilitate any transactions using an Eligible Card in the Digital Wallet. We may share your information with the Digital Wallet Provider to make information available to You in the Digital Wallet about your transactions or to assist the Digital Wallet Provider in improving the Digital Wallet. Vancity has a Privacy Code that explains in more detail why we collect your personal information, how we keep it safe, how we will use it and when we might share it with others. We will not share your information in a way that is not consistent with the Privacy Code. We will also treat the personal information we obtain as a result of your use of the Digital Wallet in a manner that is consistent with the terms of our Privacy Code. By enrolling your Card into the Digital Wallet, You are consenting to the collection, use and disclosure of your information for these purposes and in accordance with our Privacy Code. You may obtain a current version of the Vancity Privacy Code at your branch or by accessing our website at vancity.com. The Digital Wallet Provider may use your information for other purposes so it is important that You review the Digital Wallet Provider's privacy statements relating to their use of your information. Vancity will not be responsible for any loss or injury or other harm You may suffer in connection with the Digital Wallet Provider's use of your information. We are also not responsible if there is a security breach affecting any information stored in, or sent from, the Digital Wallet.
- Limitations on our Responsibilities
Using a Digital Wallet Provider's service is something that, if You choose to do, You are doing at your own risk. We have no responsibility for the security, accuracy or any other part of the content or function of the Digital Wallet or for any third party's products or services provided in connection with the Digital Wallet. It is important for You to understand that we will not be responsible for:
- any thing or circumstance that may delay or interrupt or prevent You from using a Card in your Digital Wallet;
- the accuracy of any information displayed either in your Digital Wallet, on your Device or on the software or hardware it contains, or on any wireless service used to access, maintain or use a Card in a Digital Wallet;
- the privacy or security of the electronic transmission of personal information through any third party connections and networks; and
- any security breach affecting any information that is stored in or sent from your Digital Wallet or the Device. The Digital Wallet is provided to You, to the fullest extent permitted by law, as is and as available with all defects that may exist from time to time and without warranty of any kind.
- Changes to these Terms of Use
Vancity has the right to stop offering or participating in the Digital Wallet service and as such, may terminate these Terms of Use and the availability of a Digital Wallet at any time. We may also make changes to these Terms of Use at any time. If we make changes, subject to applicable law, we will provide notice if required by law. A copy of the most recent Terms of Use is always posted on Vancity's website for your reference. If You continue to use your Card in your Digital Wallet in any way after we have notified You of a change to these Terms of Use, that will mean that You have agreed to the change. You can terminate these Terms of Use at any time by removing all Cards from the Digital Wallet.
- Notices
By enrolling a Card into a Digital Wallet, You consent to receive electronic communications, notifications and messages from Vancity and from our service providers that work on our behalf to service your Card Account, including enrollment and transaction information. These communications may come by e-mail, SMS text, on your Device or through the Digital Wallet Provider. You are responsible to update us if your e-mail address or cellphone number changes by using our contact information set out in the Card Contract. If You wish to withdraw your consent to receive such electronic notifications You can do so, but if You do, You will not be able to continue to use your Card in the Digital Wallet.
- Headings and Interpreting these Term of Use
The headings to each section of these Terms of Use are for convenience and do not change the meaning of any provision. These Terms of Use are made under the provincial law of British Columbia and any federal laws of Canada that apply in British Columbia.
